In this episode of the Arbitration World podcast series Carolyn Branthoover and Julian Veintimilla from the K&L Gates Pittsburgh office discuss arbitration clauses which specify eligibility criteria for the arbitrators. Our speakers discuss a recent English Court of Appeal decision regarding the interpretation and application of such a clause in an insurance policy and how such issues might be dealt with by a U.S. court. They also address what insurance policyholders can do when presented with such clauses.
